I was taken to the center at 9:00 am and returned home at 1:00 pm. There I was able to meet with the criminal investigator who is handling Hamlet’s case, First Lieutenant Arelis; and I was able to speak for a few minutes with Hamlet in the presence of the investigator, First Lieutenant Moreno and a State Security agent.

Hamlet Lavastida is being investigated for the charge of Instigation to commit a crime. The procedural term of the detention met the 72-hour deadline this morning, as Lavastida was detained on Saturday 26th at 9:30 am at the quarantine center where he was being held after having complied with the safety measures imposed on people coming into Cuba from abroad. At this moment his file is at the Prosecutor’s Office. The criminal investigator explained to me Prosecutor’s Office has 72 hours now makes its decision regarding this case, and I am entitled to see the document, and then to appoint a lawyer if the case proceeds. In the meantime, Hamlet continues to be interrogated as part of his investigation process.
The criminal investigator did not give me details about the investigation, assuming that I knew what this “instigation to commit a crime” was. In other conversations with State Security, I have been made aware that the evidence that state is investigating Hamlet about comes from a private Telegram chat conversation of the 27N group. It was leaked and analyzed by television commentator Humberto López on NTV Nacional. In that chat Hamlet makes a comment about the idea of marking bills with wedges designed with the acronyms MSI and 27N to extend the brand of these groups in the realm of symbolic space. This idea was not made into a civic action of the 27N group and was never made public by any member, including Lavastida.

Regarding the Instigation to commit a crime, the Penal Code, article 202.1 states that- “Whoever, outside the case provided in paragraph c) of article 125, PUBLICLY incites to commit a specific crime, incurs the penalty of deprivation of liberty from three months to one year or a fine of one hundred to three hundred quotas”. Here we can ratify, based on their own laws, that this does not apply, since the evidence referred to is PRIVATE correspondence illegally accessed by the very state that condemns him. Nor was there any instigation, because the group debates proposals among Cuban citizens in a PRIVATE framework. Proposals are agreed upon, and only those approved by all are published. In the case of this idea, it was never debated, so it was never carried out, much less made public.

202.2. “If the incitement takes effect, the sanction corresponding to the crime committed is imposed if it has a higher sanction than the one indicated in the previous paragraph.” The alleged “incitement” did not come out of the private space of the 27N chats, nor through any of its members, so it could not have taken effect. However, the NTV Nacional did incite indirectly by making Hamlet Lavastida’s idea public. It was Humberto Lopez who introduced the idea of marking banknotes into the popular imagination. The expression of an idea in private, even if it foreshadows the possible commission of a crime, cannot be sanctioned if it does not materialize. In criminal law, this is called a preparatory act. As a rule, preparatory acts are not punishable.

202.3. “If the incitement is to breach a law, a legal provision or a measure adopted by the authorities the penalty is deprivation of liberty from one to three months or a fine up to one hundred installments.” Neither the BCC nor the Penal Code in force suggests that the act of writing or marking banknotes as a crime. However, Decree-Law No. 363 on Administrative Violations of Banking, Financial and Exchange Provisions establishes some administrative sanctions to: “stamping on banknotes any word, phrase, slogan, motto, slogan, sentence, legend, drawing, advertisement or mark, whether in handwritten or printed form or by other means.” If Hamlet Lavastida is charged for this idea (not act or deed), it would be confirmation that the Cuban authorities consider the idea of marking banknotes to be criminal.

202.4. “The same sanction as that provided for in the preceding paragraph shall be incurred by anyone who incites the non-fulfillment of citizen duties related to the defense of the Homeland, production or education.” The artist Hamlet Lavastida proposed to mark the bills with the logos of the San Isidro Movement and the 27N group. Neither of these two organizations are against the defense of the Homeland, production, or education, on the contrary, they are civil society groups that defend equal civic and political rights from culture.
Now, the idea of marking the banknotes comes from an artistic project (intervention), collected in sketches and drawings like the one shown in the attached image. It is an idea conceived at the symbolic level, for the symbolic, which in turn can be extended and applicable to any reality. This is not a preparatory act. There are preparatory acts that are punishable, those that have to do with crimes against State Security.

Article 125 of the PC recognizes that it is punishable as a preparatory act the fact of “inciting another or others, by word or in writing, PUBLICLY OR PRIVATELY, to execute any of the crimes” included in the title of crimes against State Security. However, if this article were to be applied to the idea of marking Hamlet’s banknotes, the Cuban authorities would have to charge him with a different crime than that of Instigation to commit a crime under article 202. To charge Lavastida with this article 125 of the CP, they would have to charge him with one of the crimes dedicated to protecting the security of the Cuban state and the political order. And this would confirm that charging Hamlet with a crime against State Security for suggesting the idea of marking banknotes with the logos of the MSI and 27N civic groups would be politically motivated repression. This would make Hamlet Lavastida a possible political prisoner, a prisoner of conscience.

The State Security incurs in a crime at its discretion under inferences of those who could cause a private proposal in a virtual chat. Many of us activists, including myself, have carried out actions public space, we have demonstrated in the streets, we have raised posters, sheets, we have resisted, and we are living in freedom; although we are under investigation, with precautionary measures and under constant police siege. It has been demonstrated, without a doubt, that the application of the laws is selective and politically motivated, as is happening in the case of Lavastida. Many of the cases of prisoners of conscience who are currently in prison serve the State Security as exemplary measures and as bargaining chips. In no case has there been a transparent and fair legal treatment. Because at all times, the balance has been completely tilted towards the protection of the State. And it is precisely the State that criminalizes. Because the government has taken over our State, our Constitution, and our laws. The government has taken over our rights, and in that sense, we are totally unprotected.

Hamlet is physically well. He spoke very calmly and showed himself to be in control of his case. In the few words we were able to exchange about his process he said: this is an unusual thing that is happening, and they (State Security) know it.

Beyond the justification of the marked bills, State Security has shown me other reasons why they consider Hamlet a threat to them. At all times they have referred to him as a cultured and articulate person. There is a paranoia and exaggeration of the status of Hamlet within our resistance groups, they see him as a kind of political guide, an ideologue, an advisor, a thinking and strategic head. Hamlet, in other words, is being condemned for his inordinate intelligence. Towards the end of our guarded -and by guarded-, squalid conversation, while he was getting up from his seat, to be led back to his cell, he managed to tell me: “remember that tomorrow is the 60th anniversary of Words to the Intellectuals. I love you.”
